Present Technologies License Agreement for Phune Gaming

DEFINITIONS
"Present Technologies" shall mean the IT company which has invented, developed and holds the copyrights of the Phune Gaming Platform.

"Phune Gaming Platform" shall mean a software product developed by Present Technologies which provides a platform for publishing Games.

"Phune Gaming Client Platform" shall mean the component of the Phune Gaming Platform which is distributed to third party developers with intent to develop Games for the Phune Gaming Platform.

"Games" shall mean a software product developed by third parties for the Phune Gaming Platform, this may include, but not limited to, source files, media files and libraries which were used in the development.

LICENSE TO USE
Subject to the terms and conditions of this License, "Present Technologies" grants you a worldwide, non-exclusive, non-transferable, no-charge license to use the "Phune Gaming Client Platform" with the sole purpose of developing "Games" which will only be published on the "Phune Gaming Platform".

RESTRICTIONS
"Phune Gaming Client Platform" is copyrighted. It's intellectual property rights are retained by Present Technologies. Unless enforcement is prohibited by applicable law, you may not modify, decompile, or reverse engineer the "Phune Gaming Client Platform". You acknowledge that the Software is developed with the only purpose of developing "Games" for the "Phune Gaming Platform".

DISCLAIMER OF WARRANTY
The "Phune Gaming Client Platform" is provided on an "AS IS" basis, without warranties or conditions of any kind, either express or implied.

LIMITATION OF LIABILITY
In no event shall Present Technologies be liable for any indirect, incidental, special, punitive or consequential damages, or damages for loss of profits, revenue, data or data use, arising as a result of this License or out of the use or inability to use the "Phune Gaming Client Platform".

TRADEMARKS AND LOGOS
This License does not grant permission to use the trade names, trademarks, service marks, logos or product names ownership of Present Technologies.

GOVERNING LAW
This agreement is governed by the laws of Portugal. You and "Present Technologies" agree to submit to the exclusive jurisdiction of, and venue in, the courts of Coimbra in any dispute arising out of or relating to this agreement.
